Home is Here, Supreme Court Rules Against Trump in DACA case

The only authoritarian level of resistance coming against Trump is from an unexpected source. Yes, the Supreme Court is ruling against the President’s decisions and giving him an ultimatum. On Thursday, the Supreme Court said that Trump’s administration's plan to shut down the Deferred Action for Childhood Arrivals will not be regulated because of a lack of adequate justification.

 

During Obama’s time in 2012, this law was implemented and gave protection to young immigrants against illegal deportation. They are allowed to stay in the country as “Dreamers'' and obtain work permits to earn lives.

However, it is not a surprise that Trump’s government has always been against minorities and immigrants so they tried to shut down the program. The administration said that even though DACA is legal, the Department of Homeland Security can remove anyone without a review from court case because according to them DACA “was a temporary stopgap measure that, on its face, could be rescinded at any time.”

 

Before the Supreme Court ruled in favor of the implementation of the law, even the lower court argued that Trump’s administration did not provide adequate evidence to remove it.

 

Justice John Roberts wrote the decision and said that Trump and his government were unaware of the negative effects this removal of law would have on the children who rely on the protection. However, we all know that the Supreme Court seldom comes up with sensible decisions so they did not rule out the possibility of eliminating DACA; they just said that the administration’s evidence was not enough.

 

“We do not decide whether DACA or its rescission are sound policies,” Roberts wrote. “We address only whether the agency complied with the procedural requirement that it provide a reasoned explanation for its action. Here the agency failed to consider the conspicuous issues of whether to retain forbearance and what if anything to do about the hardship to DACA recipients.”

 

You can guess how upset Trump and his fans were after the decision, especially when last week the Supreme Court also issued an order of workplace protections for the LGBTQ+ community.

The Supreme Court is being lauded by others and social media is full of celebration right now as this means a secure future for a lot of immigrant children who will be able to acquire work without Trump’s administration threatening their citizenship.
